Our client was driving in a parking structure when she accidentally misapplied the pedals and pressed the gas while parking instead of the brake. She went over the parking stop and hit the cable restraint which failed and her car tumbled over the edge. Defendants argued that it was only because of our client’s negligence that the accident occurred and that the cables were not designed to withstand so much force. We argued that it is foreseeable that someone might misapply the pedals and that the barrier should have held and we were able to settle for $500,000 before trial.
